Checked against the primary document on October 4, 2026. The library's summary, tags and figures for this record were compared with the regulator's own document by an AI model (Claude) following written instructions, with sampled and disputed records read a second time. No lawyer has reviewed them. A checked record can still contain errors, and checked does not mean endorsed. See how we check records or report a correction.
The SEC's September 2015 Endeavor Power pump-and-dump case ended with a final judgment against Marco Babini on 27 September 2024 in the District of Massachusetts. It enjoins him and bars him from penny stock offerings; the release states no money. Co-defendants Edward Withrow (2019) and Samuel Brown (2019) had already settled.

What is alleged to have happened
The Securities and Exchange Commission announced this matter on September 14, 2015 as release LR-23346. The respondents named are Marco Babini et al. (1 individual, 0 entities).
The complaint alleges that the chairman of Endeavor Power and two others used it as a vehicle for a pump and dump of secretly controlled shares, thwarted by a trading suspension. No paid-promotion charge is made, so that tag has been removed.
This library tags the matter as pump and dump and undisclosed control blocks, based on the conduct the regulator describes. Each tag links to a page explaining how that technique works, what statute it engages, and what penalties comparable actions have attracted. The tagging is ours, not the regulator's: agencies charge statutory provisions, not technique names.
The conduct is recorded against equities.
Non-monetary relief recorded: officer-and-director bar, penny stock bar.
The release references a parallel criminal proceeding. Where a criminal case exists, the civil and criminal outcomes are recorded separately, because they resolve on different standards of proof.
Nothing in the regulator's filing has been proven, and the respondents are entitled to the presumption that it has not been. This page will be updated if the matter is resolved, dismissed or withdrawn.
The SEC reports that the District of Massachusetts entered a final judgment against Babini, a Canadian resident, on 27 September 2024. It enjoins him from violating antifraud provisions of the Securities Act and Exchange Act, including Section 9(a)(2), and prohibits him from participating in a penny stock offering; the release gives no disgorgement or penalty. After a three-year extradition effort he pleaded guilty on 20 December 2023 in the parallel criminal case, and the release says the court entered a final criminal judgment on 18 March 2024. The SEC's earlier releases record consent judgments against Withrow on 12 March 2019, which also barred him as an officer or director for five years, and Brown on 29 July 2019, so all three defendants have now been resolved. The release says nothing of any sentence length.
