In August 2018 a Boston federal court entered a final judgment against hedge fund manager Yasuna Murakami and his two advisory firms for hiding trading losses and misappropriating investor money. They agreed to pay more than $7.9 million in disgorgement and interest, deemed satisfied by a criminal restitution order; Murakami was sentenced to six years.

What is alleged to have happened

The SEC announced the judgment on August 6, 2018 (LR-24226). It had sued in May 2017 over a scheme in which Murakami misappropriated investor funds and sent fabricated statements through his partner Avi Chiat, whom the SEC was still litigating against. About $1.3 million went out as Ponzi-like payments to investors seeking redemption, one use of the diverted money rather than the charged scheme. Murakami pleaded guilty to wire fraud, received six years, and was barred from the industry in May 2018.

The record carried $7.9 million as disgorgement; the release gives it as disgorgement and prejudgment interest combined, so the figure is blank. The Ponzi tag is removed because the release describes a hedge fund loss-concealment and misappropriation fraud.
